Rowan Co. will book A, pages 261-263, records will of J. W. Fouch, dated 17 Feb 1940, codicil dated March 1940, both recorded for probate 8 April 1940. The will gives $1 to son Lester, $500 to son Addison Fouch to be used for education, and forfeited to the estate if not used for that purpose within a reasonable period to be determined by the executor, and remainder of estate to be divided equally between children Audra Fouch, Ruby Fouch, Harris Burl Fouch, Reba Fouch Caskey, Cledith Fouch Johnson, Nola Fouch Hayes, and Addison Fouch. Executor to be his brother, Thomas E. Fouch. The codicil stipulates that should any beneficiary take possession of any portion of the estate before it is legally divided, the bequest to that person shall be reduced to $1. Witnesses to the original will were Mrs. Sue Fugate and Wm H. McBrayer, witnesses to the codicil were J. M. Butler and Stella Crosthwaite.
