His will as recorded in Fleming County stated:

I, Joseph H. Gregory, of Fleming County, being of sound and disposing memory make and declare this to be my last and only will hereby revoking all wills heretofore made.

1st. I will and direct that my debts & funeral expenses be paid.
2nd. I have made to my daughters certain gifts, Irene Porter, wife of Jess Porter & Eva Lee Gregory, wife of Smith Gregory, said gifts being all that I desire them to have out of my estate.

3rd. I will and bequeath to my wife, Lina S. Gregory, and my son Nathan Thomas Gregory, all of my property consisting of my farm & farm implements, stock & crops of all kinds and description to be held by my wife Lina S. Gregory & son, Nathan, jointly during my wife's life and at her death I will and bequeath that her interest shall invest completely in Nathan my son.

I hereby appoint my wife Lina S. Gregory as Executrix of this will. Given under my hand this 26th day of May, 1919.

At a continued session of the Fleming County Court held on the 3rd day of May, 1924. An instrument in writing purporting to be the last will and testament of Joseph H. Gregory was produced in open court and ordered to lie over for proof and on the 7th day of May was again produced in open court and proven by the two attesting witnesses, viz:

L.L. Emmons and J.B. Booten, who after being duly sworn, each stated that he signed same at the request of the Testator and in his presence and in the presence of each other and at the time of signing same said Testor was of sound mind and disposing memory all of which is accepted and approved by the court and said instrument of writing ordered to be filed and recorded as the last true will and testament of Joseph H. Gregory, deceased, which is done.
