Notes for Arthur Foster
Fleming County Will Book H, page 45, records:

I Arthur Foster of Fleming County do hereby make my last will and testament in the following manner: that is to say first I desire that all my debts to be paid out of the money that is owing me and burial expenses and the balance of the money if any should equally be divided between Milton Foster my son and Priscilla Foster late Day. I bequeath to my son Milton Foster a certain portion of my lands on Turkey Run all that part beginning at the lane between said Foster's and Squire Day running with the orchard fence until it strikes the lane running to Turkey Run. Running with said lane to the end of the same. Thence straight on with the woods pasture fence to the south line between me and Richard Vanlandingham. It is hereby understood that my son Milton Foster shall include the house and orchard. I give to my daughter Priscilla Foster later Day all that part of my lands lying East of said Milton's part supposed to be about equally divided. I further give to my son Milton my horse and clock. All the rest of my children having given them all I ever intend. I give to my Grand daughter Eliza Jane Day my bed and beding and bedstead. This being my last will and testament hereby revoking all other  will or wills by me heretofore made in witness where of I have  hereunto set my hand and affixed my seal this 9th day of May 1843.

At a court held for Fleming County on the 26th day of May 1845. This writing purporting  to be the last will and testament of Arthur Foster, dec'd was produced in court and proven by the oaths of James Markwell and Abel Markwell subscribing witnesses thereto to be the will of said Arthur Foster, dec'd and ordered to be recorded which is duly done.
