His death certificate records Dan Fultz, age 60, born 1872 in Rowan Co., died 13 Aug 1932 in Morgan Co, married, husband of Lula Fultz, father Morgne Fultz, born in Rowan Co., Ky, mother’s maiden name Clearinda Fannin, born in Ky, cause of death gun shot and killed in fight, informant Golda Kidd, Wrigley, Ky, burial in Blair Cemetery.
An indictment filed on 5 Sep 1932 with the Morgan County Court charges that Virgil Nickell and George Johnson “did willfully and feloneously and with malace aforethought kill and murder Dan Fultz by shooting the said Dan Fultz with a gun or pistol loaded with powder and ball or some other had and combustable substance in the head and body from which shooting and wounding the said Dan Fultz did then and there die. All of said defendants were present at the time of said shooting and wounding and each of said defendants did the shooting and wounding of said Dan Fultz and aided, assisted, abetted and encouraged the other in the shooting, woundiing and murdering of the said Dan Fultz. The one that did the actual shooting and wounding of the said Dan Fultz is unknown to the grand jury but each of said defendants was present or conveniently near and did aid, assist, encourage and abet the other in the shooting and wounding aforesaid.”
